Export and import of nuclear materials, technologies, equipment, installations; of special non-nuclear materials; of dual use equipment, materials and technologies; of sources of radioactive radiation and isotope products (hereinafter referred as nuclear export and import) in the Republic of Kazakhstan is being carried out on a basis of one-time licenses that are issued by the Ministry of Industry and Trade of the Republic of Kazakhstan based on applications of defined forms.
This application should have preliminary approval of the Atomic Energy Committee (hereinafter referred as Committee).
Nuclear export and import is being carried out in accordance with legal norms and regulatory acts and with NPT and other international treaties, agreements and other international legal acts, in which Republic of Kazakhstan takes part:
• Law on Export Control of 18.06.1996 (with amendments of 24.11.2000 and 26.09.2003)
• Decree of the RK Cabinet of Ministers of 9.03.1993 No.183 "On Enforcement of Provisions on Export and Import of Nuclear Materials, Technologies, Equipment, Installations, Special Non-nuclear Materials, Dual Use Equipment, Materials and Technologies, Sources of Radioactive Radiation and Isotope Products "
• Decree of the RK Government of 30.06.1997 No.1037 "On Licensing of Export and Import of Goods (works, services) in the Republic of Kazakhstan"
• Decree of the RK Government of 14.12.1999 No.1917 "On Improvement of Export Control System in the Republic of Kazakhstan"
• Decree of the RK Government of 14.12.1999 No.1919 "On Enforcement of Rules of Export Control in the Republic of Kazakhstan and Rules of Registration of Obligations on Use of Products Subject to Export Control and Imported into the Republic of Kazakhstan and Examination of their Execution"
• Decree of the RK Government of 18.08.2000 No.1282 "On Enforcement of List of Products Subject to Export Control in the Republic of Kazakhstan”
• Decree of the RK Government of 12.02.1998 No.100 "On Enforcement of Provisions of Licensing of Activities Connected to Use of Atomic Energy"
This legal and regulatory base defines the following:
- mechanisms of implementation of licensing for nuclear export and import,
- state authorities involved into this process,
- functions, obligations, rights and interaction of these state authorities,
- assign to the Committee functions of state control in nuclear export and import,
- order and procedures of approval of nuclear export and import applications in the Committee.
In accordance with the Decree of the Government of the Republic of Kazakhstan dated 12.02.1998 No.100 "On Enforcement of Provisions of Licensing of Activities Connected to Use of Atomic Energy" such activities as export and import, and also management, production, use, transportation and transit transportation of nuclear and other radioactive materials should be licensed in the Committee.
License for nuclear export and import can be issued for legal entities only that have the Committee licenses for defined types of activities in the field of use of atomic energy.
Committee takes a decision on approval of the license application only after comprehensive evaluation of export routs and reliability of end user of the products and examination of a declaration of importing state in a case that this state is a non-nuclear weapon one.
Committee introduced on the territory of the Republic the order of preliminary notification of export of nuclear materials and provision of notes after their shipment.
